1. Agreement to These Terms
These Terms & Conditions (“Terms”) govern your access to and use of the website kekopet.com.au (the “Site”) and your purchase of products from KeKo Australia Pty Ltd, trading as KeKo Pet (“KeKo Pet”, “we”, “us”, “our”). By using the Site or placing an order, you agree to be bound by these Terms, our Refund & Returns Policy, and our Privacy Policy, each of which is incorporated into these Terms by reference.
Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) (“ACL”) or any other law that cannot lawfully be excluded.

2. Eligibility and Accounts
You must be at least 18 years of age and capable of entering a legally binding agreement to purchase from the Site.
If you create an account, you are responsible for maintaining the confidentiality of your login details and for all activity under your account. Notify us promptly of any unauthorised use.
Information you provide when ordering must be accurate, current, and complete.

3. Products and Product Information
Our products are pet treats, chews, accessories, and supplementary pet products intended for animal consumption or use only. They are not for human consumption.
We take care to describe products accurately, including ingredients and typical analysis. Natural, single-ingredient products may vary in size, shape, colour, and weight between batches; product images are illustrative.
Treats and chews are supplementary and are not a complete diet. Always supervise your pet with any treat or chew, provide fresh water, and choose products appropriate to your pet’s size, age, and chewing style.
Information on the Site is general in nature and is not veterinary advice. Consult a veterinarian regarding your pet’s specific dietary or health needs, particularly for pets with allergies, sensitivities, or medical conditions.

4. Orders
Your order is an offer to purchase. We accept an order when we issue an order confirmation and successfully process payment. We may decline or cancel an order at our discretion, including for suspected fraud, pricing or listing errors, or stock unavailability; if we do, we will refund any amount paid in full.
We may impose reasonable limits on quantities purchased per order or per customer.
Please check your order details, including delivery address, before submitting. We are not responsible for delivery failures caused by inaccurate information you provide.

5. Pricing and Payment
All prices are in Australian dollars (AUD) and include GST where applicable. Delivery charges, where payable, are shown at checkout before you confirm your order.
Payment is accepted exclusively online through our Shopify checkout using the payment methods displayed at checkout. We do not accept cash, cheque, or direct bank transfer.
Prices may change at any time without notice; the price payable is the price displayed at the time your order is placed.
Where a discount code or promotion is applied, refunds are calculated on the amount actually paid, as set out in our Refund & Returns Policy.
If a product is listed at an obviously incorrect price due to error, we may cancel the order and refund any amount paid.

6. Delivery, Risk, and Title
We deliver within Australia to the address you provide at checkout. Estimated delivery timeframes are indicative only and commence once your order is dispatched.
Risk in the products passes to you on delivery to your nominated address. Title passes on the later of delivery and receipt of payment in full.
If a delivery is returned to us as undeliverable due to an incorrect address or repeated failed delivery, we may charge reasonable redelivery costs.

7. Returns, Refunds, and Consumer Guarantees
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the products repaired or replaced if the products fail to be of acceptable quality and the failure does not amount to a major failure.
Returns and refunds, including our 14-day change-of-mind returns, are handled in accordance with our Refund & Returns Policy, available on the Site. In the event of any inconsistency between that policy and these Terms, the ACL prevails, followed by the Refund & Returns Policy in respect of returns matters.

8. Gift Cards and Promotions
Gift cards are not redeemable for cash and are not refundable except as required by law. Gift cards are valid for at least three years from the date of issue.
Promotional offers and discount codes are subject to any stated conditions, cannot be exchanged for cash, and may be withdrawn or amended at any time. One code applies per order unless stated otherwise.
Products provided free of charge (including samples and gifts with purchase) have no cash or refund value.

9. Intellectual Property
All content on the Site — including the KeKo name and logo, trade marks, branding, product names, text, images, packaging designs, and layout — is owned by or licensed to KeKo Australia Pty Ltd. You may not reproduce, distribute, modify, or use any Site content for commercial purposes without our prior written consent. Nothing in these Terms grants you any licence or right in our intellectual property except as expressly stated.

10. Acceptable Use of the Site
You must not use the Site for any unlawful purpose, interfere with its operation or security, scrape or harvest data, or upload malicious code.
If you submit reviews or other content, you grant us a non-exclusive, royalty-free licence to use that content in connection with our business, and you warrant it is your own, accurate, and not unlawful or offensive. We may remove user content at our discretion.
The Site may contain links to third-party websites. We are not responsible for the content or practices of third-party sites.

11. Privacy
We collect and handle personal information in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). By using the Site, you consent to the collection and use of your information as described in the Privacy Policy.

12. Liability
To the maximum extent permitted by law, and subject always to the consumer guarantees under the ACL:
our liability for a breach of a condition or warranty implied by law that cannot be excluded is limited, at our option, to the replacement or repair of the products or the resupply of equivalent products, or payment of the cost of doing so;
we are not liable for indirect or consequential loss arising from your use of the Site or products; and
we are not liable for loss or damage arising from misuse of a product, failure to follow feeding or usage guidance, or failure to supervise a pet, to the extent that loss was caused by that misuse or failure.
Nothing in this clause limits any liability that cannot be limited under Australian law.

13. General
We may update these Terms at any time. The version published on the Site at the time you place an order applies to that order. Continued use of the Site after changes constitutes acceptance of the updated Terms.
If any provision of these Terms is invalid or unenforceable, it is severed and the remaining provisions continue in force.
A failure by us to enforce any provision is not a waiver of that provision.
These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.
